These Terms of Use ("Terms") govern your use of the Forage application (the "App"), provided by Disconnect LLC ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and the Apple Media Services Terms and Conditions.
To keep the service sustainable, scanning and recipe generation are subject to reasonable usage limits per billing period. We may adjust these limits and may suspend access if the service is used in an abusive, automated, or fraudulent manner.
4. Food safety and no professional advice. Ingredient detection, recipe suggestions, and expiry reminders are provided for convenience only and may be inaccurate or incomplete. You are solely responsible for verifying allergens, ingredient freshness, food safety, proper cooking and storage, expiration dates, and whether any recipe is appropriate for your dietary needs and health. The App does not provide medical, nutritional, or health advice. Expiry reminders are estimates, not guarantees. Always use your own judgment, and consult a qualified professional where appropriate.
You agree not to misuse the App, including by reverse engineering it, interfering with its operation, accessing it through automated means, attempting to exceed or circumvent usage limits, or using it to violate any law.
The App, its design, and its content (excluding third-party content such as recipe photos) are owned by us and protected by applicable laws. These Terms do not grant you any rights in our trademarks or branding.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or accurate.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of the App, including any reliance on ingredient detection, recipes, or reminders. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months before the claim.
You may stop using the App at any time. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination will survive.
These Terms are between you and Disconnect LLC only, and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.
